63C | Application of Division | |
This Division applies to a document that is claimed to be an exempt document and is, or is to be, produced to the Information Commissioner in the course of the Information Commissioner— | ||
(a) | conducting a review under Division 1 of Part VI; or | |
(b) | dealing with a complaint under Part VIA; or | |
(c) | conducting an investigation under Part VIB. |
During a review, agencies and Ministers must provide the Information Commissioner with documents claimed to be exempt so the Information Commissioner may review them. An agency or Minister may also provide documents to the Information Commissioner during a complaint or when conducting an investigation.
Division 2 of Part VI outlines special requirements for producing certain documents claimed to be exempt, and the procedure for maintaining confidentiality of an exempt document where it has been produced to the Information Commissioner during a review, complaint or investigation.
Section 63C clarifies that these requirements apply to a document that an agency or Minister claims is exempt and which needs to be produced to the Information Commissioner during a review, a complaint, or an investigation.
