New FOI Access Charges Regulations

The Freedom of Information (Access Charges) Regulations 2025 (external link) came into effect on 1 June 2025, revoking the Freedom of Information (Access Charges) Regulations 2014.

Agencies should make sure to update their FOI processes and templates, to ensure they are using and referring to the 2025 regulations moving forward.

What’s changed from the previous regulations?

The 2025 regulations:

  • increase the notice of charge under regulation 8 from $50 to $70.
  • insert the word “hard copy” into item 3 of the Schedule.
  • Add a note to item 7 of the Schedule to make it clear that it only applies where a document has been created under section 19 of the Freedom of Information Act.

The 2025 regulations are otherwise the same as the 2014 regulations.

OVIC’s resources will be updated over the coming weeks, to refer to the 2025 regulations and its modest changes.

Why are there new regulations?

The old Freedom of Information (Access Charges) Regulations 2014 were due to expire on 2 June 2025 and needed to be remade.
