Information Access Series: Section 38 of the FOI Act – Secrecy provisions

OVIC hosts a monthly Information Access Series seminar for FOI practitioners in the Victorian public sector (VPS). This month, the OVIC legal team will be delivering this seminar, covering Section 38 of the FOI Act - Secrecy provisions.

Section 38 of the Freedom of Information Act 1982 (Vic) exempts documents where information in those documents is protected by a secrecy provision in another Act. However, it is often difficult to know whether those other provisions are provisions to which section 38 applies.

Please join us on 23 October for our next lunchtime Information Access Series (IAS) webinar which will:

  • look at interpreting and applying section 38;
  • discuss examples from VCAT; and
  • provide practical guidance for FOI practitioners about the application of a secrecy provision.
