Seeking review by VCAT

Agencies and Ministers can apply to the Victorian Civil and Administrative Tribunal (VCAT) for a review of the Information Commissioner or Public Access Deputy Commissioner’s decision.

An agency must make their application to VCAT within 14 days of receiving the written notice of the decision.

There may be applicable charges for a VCAT review. For further information on how to apply for a review, please visit the VCAT website.

Please note that under section 51(2) of the Freedom of Information Act 1982 (Vic) the Information Commissioner cannot be joined as party to the review.
